On Fiscal Laws

Q. What is the deifinition of Riba according to the Holy Quran and Sunnah of the Holy Prophet ( Sallaho Alaihai Wasallam ). Does it cover the simple and compound interest existing in the present day financial transactions?

A. The word, Riba as understood from the Holy Qur’an and Sunnah, is any extra payment received over and above the prin- cipal amount, regardless of the fact that extra amount is significant or insignificant. Islam, therefore, considers the Riba Haraam, in all of its forms.

The Fuqaha have given two interpretations of the word, Riba, : Riba-al-Nasia and Riba al Fadl.

Muslim reported in his Sahih that, “The Messenger of Allah (pbuh) said,

“When the slave flee away (from his master), his/her prayer will not be accepted.” (Muslim)

The Prophet (pbuh) is also reported to have said,

“Any slave that flees away, the pledge of Islam is cleared from him.”( Muslim)

Ibn Khuzaimah reported in his Sahih from the hadith of Jabir who said, “The Messenger of Allah (pbuh) said,

“There are three people whose prayer will not be accepted, nor will their good deeds be raised up to the sky, a fleeing slave until he returns to his master, a rebellious woman until her husband be satisfied with her and a drunkard until his mind is restored.

IZAR BELOW THE ANKLES

Izar is defined in Arabic to be any lower garment tied to the waist covering the lower half of the body. It includes shalwar, pants, dhooti, pajamas, thawb, etc. In hadith the Prophet divided the length of the izar into four categories:

(1) The Sunna is upto half of the shins.

(2) The rukhsa (concession) is below half the shins till the ankles.

(3) The haraam and a kabira sin are letting it go below the ankles without pride.

(4) Even stronger in prohibition and punishment is dragging or trailing below the ankles out of pride
