The Consumer Credit Scheme

Q. It is becoming common for Muslim retail businessmen in South Africa to enter into the so-called consumer credit scheme. The retailer concerned concludes a written agreement with a third party Company (“the Company”). A copy of the Specimen agreement is enclosed herewith. In terms of the Scheme:

a) The customer wishes to purchase such goods on credit over 6 months;

b) The customer is informed that the company may sell him such goods on credit and, for that purpose, the customer fills in a prescribed application containing details relating to his credit-worthiness;

Kusuf Salaah (Salaah at an eclipse)

Hadrat Abu Musa ‘Ash ‘ari (Radi Allahu Ta’ala Anhu) narrated; There was an eclipse of the sun, and the Prophet got up in trepidation fearing that the last hour had come. He then went to the mosque and prayed, standing, bowing and prostrating himself longer than I had ever seen him do. He then said, “These signs which ALLAH send do not come on account of anyone’s death or on account of his birth, but ALLAH produces dread in his servants by means of them. So when you see anything of that nature, apply yourselves to making mention of Him, supplication of Him and asking pardon of Him”. [BukhAri - Muslim]

Nafl (voluntary) Salaah on a mount (riding animal)

It was customary with the Prophet (SallAllahu Alaihi Wa Sallam) to say Salaah on the back of a riding animal irrespective of direction. He performed ruku and sajdah by signs and nods. The nodding for the Sajdah would be lower than that for the ruku. [Zad -ul- Ma’ad].

ASSURED ACCEPTANCE OF SUPLICATIONS (DUA)

A:

إِنَّ فِي خَلْقِ السَّمَوَاتِ وَالأَرْضِ وَاخْتِلافِ اللَّيْلِ وَالنَّهَارِ لآيَاتٍ لأُولِي الأَلْبَابِ (3:190)

Surely, in the creation of the heavens and the earth, and in the alternation of night and day, there are signs for the people of wisdom,

الَّذِينَ يَذْكُرُونَ اللَّهَ قِيَاماً وَقُعُوداً وَعَلَى جُنُوبِهِمْ وَيَتَفَكَّرُونَ فِي خَلْقِ السَّمَوَاتِ وَالأَرْضِ رَبَّنَا مَا خَلَقْتَ هَذَا بَاطِلاً سُبْحَانَكَ فَقِنَا عَذَابَ النَّارِ (3:191)

Who remember Allah standing and sitting, and (lying) on their sides, and ponder on the creation of the heavens and the earth (and say) ―Our Lord, You have not created all this in vain. We proclaim Your purity. So, save us from the punishment of Fire.

Hadith Number Three

Hazrat Ibn Umar R.A. reports: ‘A certain man once asked Rasulullah Sal’am: ‘What is the true condition and appearance of a Haji?’. To which Rasulullah Sal’am replied: ‘The true Haji it he who comes with disheveled hair and clothes laden in dust; and moist with sweat.’ Then another inquired: ‘O Rasulullah Sal’am which Haj is in which the voice is loudly raised; repeatedly reading the Lab’baik and the excessive shedding of the blood of the sacrificial animals’.

39) Breach of Faith

Allah Most High says,

{O ye that believe! Betray not the trust of Allah and the Messenger, nor misappropriate knowingly things entrusted to you.} (Al-anfal: 27)

Al-Wahidi (may Allah bestow mercy on him) said, “This verse is revealed concerning Abu Lubabah who was sent by the Prophet (pbuh) to the Jews of Banu Quraizah during the siege of Muslims to their land. The Jews said to Abu Lubabah, these families are living among the Jews, what do you say concerning the submission to the judgment of sai’d. Abu Lubabah then pointed at his throat meaning that Sa’d would sentence you to be slaughtered. Abu Lubabah said, “I have not moved from my place until I realized that I betrayed Allah and His Messenger.”

CONDITIONS FOR FOLLOWING THE IMAM

  1. The niyyat of the follower (muqtadi) is to be simultaneous with the tahreemah.
  2. The imam’s heels have to be in front of the muqtadi’s.
  3. The condition of the imam cannot be inferior to the muqtadi’s. it is not proper for an imam who is praying a nafl namaaz to lead someone who is praying a fard namaaz but it is ok for an imam praying a fard to lead a follower who is praying nafl.
  4. The imam cannot be praying a different fard than the muqtadi. It the muqtadi for example is praying zuhr and the imam is praying asr, then the following of the muqtadi is not valid.

Conditions which Permit one not to Fast

  1. A person experiences a sickness which could be aggravated by fasting and he fears that if he had to fast, his sickness would worsen or that his recovery would be delayed or that he would die. In all these instances he should not fast. Once he recovers from his sickness, he must keep qada for the fasts which he missed. However, this concession cannot be obtained by mere thinking and the fast cannot be left out merely on this basis. Instead, when a pious Muslim doctor says that fasting would be detrimental to the sickness, only then will it be permissible to leave out a fast.

THE PROPHET’S AUTHORITY TO MAKE LAWS

A number of verses in the Holy Quran establish the authority of the Holy Prophet (SAWS) as a legislator or a law-maker.

Some of those are reproduced below:

1) The Holy Quran says:

“And My mercy embraces all things. So, I shall prescribe it for those who fear Allah, and pay Zakah (obligatory alms), and those who have faith in Our signs, those who follow the Messenger, the unlettered Prophet whom they find written down in the Torah and the Injeel, and who bids them to the Fair and forbids them the Unfair, and makes lawful for them the good things, and makes unlawful for them the impure things, and relieves them of their burdens and of the shackles that were upon them. So, those who believe in him, and honor him, and help him, and follow the light that has been sent down with him – they are the ones who acquire success” (7:157)

How may a Layman Recognise the Mujtahid?

(6) We have stated in the beginning that taqleed, whichever of the two kinds you consider, is nothing more than to ask one who is in adept in the science of Qur’an and sunnah and whose understanding, insight and juristic knowledge is reliable, that one who is incapable may know.

Some people wonder how an ignorant seeker will distinguish an adept imam? (Tahreek Azadi Fikr p13)
